Having had more that a little bit of contracting experience with the DoD, I can assure you that the lawsuit will come back and bite Bezos in the keester. Ill will is something that contracting officers never forget.

Government agencies can not exclude a company from bidding on a contract just because the management team doesn't like them. If they choose a contract that costs more, they have to justify why. And DoD also plays by a different set of rules than a civilian agency such as NASA.

You are correct... They can bid anytime they like. However, the DoD breaks things and kills people when the President tells 'em too. I worked for the DoD thirty-seven years and only had one contract-related, FOIA challenge... I killed that in about ten minutes.
