In the battle between these new "masters of the universe " figures we probably are going to see more litigation then we even do now if the titans don't get their way.

It's almost like I get estimates from two contractors to do work at my house, I go with contractor A, then B sues me. :lol:

I really don't see Bezos winning this one. SpaceX simply has too big a lead in operational experience, too many successful launches to be ignored. Blue origin needs to focus on putting payloads into orbit for anyone they can before they will be taken seriously.
Any metaphor will tear if stretched over too much reality.

Having had more that a little bit of contracting experience with the DoD, I can assure you that the lawsuit will come back and bite Bezos in the keester. Ill will is something that contracting officers never forget.

Government agencies can not exclude a company from bidding on a contract just because the management team doesn't like them. If they choose a contract that costs more, they have to justify why. And DoD also plays by a different set of rules than a civilian agency such as NASA.

You are correct... They can bid anytime they like. However, the DoD breaks things and kills people when the President tells 'em too. I worked for the DoD thirty-seven years and only had one contract-related, FOIA challenge... I killed that in about ten minutes. (Don't ask me about classified contracts.)
